We reserve the right to refuse service or cancel orders where these requirements have not been met.

2. Products and Availability

We make every effort to accurately display our products, colours, and sizing. Please note that colours may vary across devices, measurements are approximate, and availability is subject to stock levels.

We reserve the right to update product information or discontinue products without prior notice.

3. Pricing

All prices are listed in South African Rand (ZAR) and include VAT where applicable. Delivery costs are charged separately unless otherwise stated. Prices are subject to change without notice.

The price displayed at the time of purchase will apply to your order. In the event of a pricing error, we reserve the right to cancel or refuse the order and issue a refund where payment has already been made.

4. Orders

When you place an order, you are making an offer to purchase products from us.

An order is only accepted once:

Payment has been successfully received, and
You receive an order confirmation email from us.

We reserve the right to refuse, cancel, or limit orders at our discretion, including where:

Products are unavailable.
Payment cannot be verified.
Fraudulent activity is suspected

As our products are made in small batches and available in limited quantities, we reserve the right to limit the number of items purchased per customer or order.

If we cancel an order after payment has been received, we will issue a full refund.

5. Payment

Payments are securely processed through our approved third-party payment providers. We do not have access to your full payment details. By placing an order, you confirm that you are authorised to use the selected payment method.

6. Shipping and Delivery

We currently only deliver within South Africa unless otherwise stated.

Delivery timeframes are provided as a guide and may vary depending on factors outside of our control. We are not responsible for courier delays or additional courier charges. Risk in the goods passes to the purchaser once the order has been dispatched.

Please ensure that delivery information is accurate. We are not responsible for delays or failed deliveries resulting from incorrect information supplied by the customer.

7. Returns and Exchanges

We do not currently offer refunds for change-of-mind purchases. Exchanges may be considered in the following circumstances:

Incorrect size received
Incorrect item received
Faulty or defective item

To be eligible for an exchange, items must be unworn, unwashed, in their original condition, and have all original tags attached.

All exchange requests are subject to our Returns and Exchanges Policy.

8. Defective or Incorrect Products

If you receive a faulty, damaged, or incorrect item, please contact us within 7 days of delivery. Once the issue has been verified, we will arrange a replacement, exchange, or repair where appropriate.

9. Gift Cards and Promotional Codes

Gift cards, discount codes, and promotional offers are non-transferable, cannot be exchanged for cash, and may be subject to expiry dates and specific terms. We reserve the right to amend or cancel promotions at any time.

10. Intellectual Property

All content on this website, including our branding, logos, product designs, images, photography, graphics, text, and website design, is owned by or licensed to CHOM (Pty) Ltd and protected by applicable intellectual property laws.

No content may be copied, reproduced, modified, distributed, sold, or otherwise used without our prior written consent.

11. User Conduct

You agree not to use this website for any unlawful purpose, attempt to gain unauthorised access to our systems, introduce malicious software, interfere with the website’s operation or security, or use our content without permission.

Any misuse of the website may result in restricted access and legal action where appropriate.

By submitting reviews, comments, photographs, social media content, or other materials to us, you grant CHOM (Pty) Ltd a non-exclusive, royalty-free licence to use, reproduce, publish, and display such content for marketing and business purposes.

You confirm that you own the content, or have permission to share it, and that it does not infringe the rights of any third party. We reserve the right to remove any content at our discretion.

Your privacy is important to us. Any personal information shared with us is governed by our Privacy Policy and the Protection of Personal Information Act (POPIA) in South Africa. We will never sell your personal information. Information will only be shared as outlined in our Privacy Policy.

14. Limitation of Liability

CHOM (Pty) Ltd is not liable for any indirect or consequential damages, or for delays, interruptions, or errors beyond our reasonable control. While we strive to keep the website available and functioning properly, we cannot guarantee uninterrupted or error-free access.

These Terms do not affect any rights that cannot legally be excluded under South African law.

15. Indemnity

You agree to indemnify and hold harmless CHOM (Pty) Ltd, its owners and our team from any claims, damages, losses, liabilities, and expenses arising from the use of the website or violation of these Terms.
